Welcome to filamexus.com (“Website”). These Terms & Conditions (“Terms”) govern your access to and use of our Website and Services provided by Filamexus Labs, trading as Filamexus (a Sole Trader). By using our Website or ordering Services, you agree to these Terms in full.

1. Definitions

  • “Filamexus Labs”, “we”, “us”, “our”

  • “You”, “User”
    Any individual or entity accessing the Website or ordering Services.
  • “Services”
    All online 3D-design tools, AI-driven CAD, print-on-demand, tutorials, consulting and related offerings via our Website.

2. Acceptance of Terms

  1. By registering, browsing or ordering, you accept these Terms and our Privacy & Cookie Policies.
  2. If you do not agree, do not use our Website or Services.

3. Registration & Accounts

  1. You must be ≥16 years old or have parent/guardian consent.
  2. Provide accurate, up-to-date details and keep them current.
  3. You’re responsible for all activity under your account and safeguarding your password.
  4. We reserve the right to suspend or terminate accounts for breach of these Terms.

4. Services & Orders

  1. Scope: Browse or upload design files (STL, OBJ, etc.), choose materials, finishes, quantities, and delivery options.
  2. Process:
  • Place an order via Website; payment is due at checkout.
  • We confirm receipt, then commence production.
  • You’ll receive shipping/tracking details upon dispatch.
  1. Changes: We may update, modify or discontinue any Service at any time without notice.

5. Pricing & Payment

  1. All prices are in GBP/EUR and exclude VAT where applicable.
  2. We accept major credit/debit cards, PayPal and bank transfers.
  3. Payment is due on order. Unpaid orders may be cancelled or suspended.
  4. You’re responsible for any currency conversion or transaction fees.

6. Delivery, Risk & Title

  1. Delivery estimates are indicative; delays by carriers are outside our liability.
  2. Risk transfers to you once the carrier collects your order.
  3. Title transfers upon receipt of full payment (including shipping).

7. Cancellation & Refunds

  1. You may cancel non-custom, in-stock orders within 14 days of purchase.
  2. Custom designs or digitally delivered Services cannot be cancelled once production/download has begun.
  3. Refunds, if approved, will be processed within 14 days of cancellation.
  4. We may refuse refunds if designs don’t meet specifications or breach these Terms.

8. Intellectual Property

  1. All Website content (text, graphics, code, models) is © 2025 Filamexus Labs or licensors.
  2. You may view/download content for personal, non-commercial use only.
  3. You retain IP in designs you upload but grant us a royalty-free licence to reproduce, modify and distribute solely to provide Services.

9. User-Generated Content

  1. You warrant that uploads do not infringe third-party rights or contain unlawful content.
  2. You grant us a licence to use, host and publish your content to deliver and promote our Services.
  3. We may remove or refuse any content at our discretion or under notice from rights-holders.

10. Privacy & Data Protection

  1. We process personal data per our Privacy Policy and GDPR.
  2. You have rights to access, rectify, erase, restrict processing, portability and objection.
  3. We use cookies as described in our Cookie Policy.

11. Warranties & Disclaimers

  1. Services are provided “as is” and “as available.”
  2. We disclaim all warranties (express or implied), including fitness for a particular purpose and non-infringement.

12. Limitation of Liability

  1. Nothing limits liability for death or personal injury caused by our negligence.
  2. Our total aggregate liability under these Terms shall not exceed the fees you paid in the 12 months preceding any claim.
  3. We are not liable for indirect, consequential, incidental, punitive or special damages (including lost profits or data).

13. Indemnity

You agree to indemnify and hold Filamexus Labs, its officers, employees and agents harmless from any claim, loss or expense arising from your breach of these Terms or misuse of our Services.

14. Termination

  1. We may suspend or terminate your access if you breach these Terms or at our discretion with 7 days’ notice.
  2. Upon termination, any licences granted to you end and you must cease use of all downloaded materials.

15. Force Majeure

We’re not liable for failures or delays caused by events beyond our reasonable control (e.g., natural disasters, strikes, pandemics, IT outages).

16. Notices

  1. We may send notices via email or Website banner.

17. Assignment

You may not assign any rights or obligations under these Terms without our prior written consent. We may assign to an affiliate or successor.

18. Severability

If any provision is held invalid or unenforceable, the remainder of these Terms remains in full force.

19. Waiver

No failure or delay in enforcing any right under these Terms shall constitute a waiver of that right.

20. Entire Agreement & Variations

These Terms, together with our Privacy & Cookie Policies, constitute the entire agreement. We may amend these Terms; changes take effect upon posting with a revised “Effective Date.”

21. Governing Law & Jurisdiction

These Terms are governed by English law. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

22. Export Controls & Sanctions

  1. We comply with UK, EU & UN sanctions and export-control laws.
  2. You agree not to export, re-export or supply any Services or goods to:
  • Persons or entities on any applicable sanctions list
  • Embargoed or restricted territories (e.g. Crimea/Donetsk/Luhansk, Iran, North Korea, Syria, Cuba, Russia)
  1. You warrant neither you nor your end-recipients are located in or citizens of a sanctioned jurisdiction.
  2. We may refuse or cancel orders that violate export controls or report suspicious transactions to authorities.

23. Prohibited Items & Activities

You may not use our Services to produce:

  • Firearms, firearm components, ammunition or magazines
  • Weapons, weapon accessories or parts designed to inflict harm
  • Illicit drug manufacturing equipment or paraphernalia
  • Counterfeit currency, stamps, trademarks, patents or IP-infringing replicas
  • Obscene, defamatory or hate-speech materials
  • Regulated medical implants/devices requiring MHRA/CE approval
  • Any item whose manufacture, possession or distribution is illegal under UK/EU law

We reserve the right to inspect, refuse or destroy any design or item that breaches these prohibitions.

24. Compliance with Laws

You agree to comply with all applicable laws, regulations and standards (including health & safety, environmental, data-protection and consumer-rights laws). Non-compliance may result in order cancellation, account suspension and referral to enforcement agencies.
