Terms of Service

1. ACCEPTANCE OF TERMS

By accessing or using the websites, software, tools, forums, or services (collectively, the “Services”) provided by Filamexus (“Filamexus,” “we,” or “us”), you (“User” or “you”) agree to be legally bound by these Terms of Service (“Terms”). These Terms govern your use of all Services, including AI tools, 3D printing resources, and community platforms. If you do not agree to these Terms, you must immediately cease all use of the Services. Continued use constitutes unconditional acceptance of these Terms and any future amendments.

2. DEFINITIONS

  • “AI Tools”: Machine learning models, algorithms, or software provided by Filamexus for design generation, optimization, or analysis.
  • “User Content”: Any text, code, 3D models, images, or data uploaded, generated, or shared by Users.
  • “Prohibited Items”: Objects or designs violating Section 4.3 (e.g., weapons, regulated medical devices).
  • “Open-Source License”: Licenses such as GPL, CERN OHL, or MIT governing shared content.

3. ELIGIBILITY & REGISTRATION

3.1 Age Requirement

  • Users must be 18 years of age or older or have legal guardian consent. Businesses must ensure authorized representation.

3.2 Account Creation

  • Provide accurate, current, and complete information during registration.
  • You are solely responsible for maintaining the confidentiality of your account credentials and all activities under your account.
  • Filamexus reserves the right to refuse service, suspend, or terminate accounts at its discretion.

3.3 Account Security

  • Notify Filamexus immediately of unauthorized access or breaches on our contact form on our website.

4. ACCEPTABLE USE

4.1 Permitted Use

You may use the Services only for lawful purposes, including:

  • Designing, sharing, or printing non-regulated 3D models.
  • Collaborating on open-source projects.
  • Accessing educational resources and tutorials.

4.2 Prohibited Activities

You agree NOT to use the Services to:

  • Design, generate, or distribute Prohibited Items (e.g., firearms, explosives, medical implants, aerospace components).
  • Violate intellectual property rights (e.g., upload copyrighted designs without permission).
  • Engage in harassment, hate speech, or discriminatory conduct.
  • Reverse-engineer, decompile, or exploit vulnerabilities in Filamexus software.
  • Train AI models on unauthorized datasets (e.g., copyrighted materials, sensitive personal data).

4.3 Content Restrictions

User Content must NOT:

  • Infringe patents, trademarks, or trade secrets.
  • Contain malware, viruses, or harmful code.
  • Promote illegal activities or violate export control laws.
  • Have a likeliness to cause harm or distress or be used in a crime against property or the person.

5. INTELLECTUAL PROPERTY

5.1 Filamexus Ownership

All software, logos, documentation, and AI models (“Filamexus IP”) are owned by Filamexus or its licensors. You receive a limited, non-exclusive, revocable license to use Filamexus IP solely for permitted purposes.

5.2 User Content

  • You retain ownership of User Content but grant Filamexus a worldwide, royalty-free, sublicensable license to host, display, and distribute it in connection with the Services.
  • Content shared under Open-Source Licenses must comply with their terms (e.g., attribution, copyleft requirements).

5.3 Copyright Claims

Filamexus complies with the Digital Millennium Copyright Act (DMCA). Submit takedown requests to our contact form on our website with:

  • A physical or electronic signature.
  • Identification of the infringing material & contact information and a statement of good faith.

6. AI TOOLS & ETHICS

6.1 Training Data

  • Filamexus AI Tools are trained on public domain datasets or materials with explicit permission. Users may opt out of data collection for model improvement via account settings.

6.2 AI Outputs

  • AI-generated designs are provided “as-is.” You assume all risks related to functionality, safety, and legality.
  • Filamexus disclaims liability for damages arising from AI outputs, including design flaws or regulatory non-compliance.

6.3 Ethical Guidelines

  • Transparency: Users must disclose AI involvement in design creation.
  • Sustainability: Prioritize eco-friendly materials and waste reduction in AI-generated designs.

7. MONETIZATION & FEES

7.1 Free Services

Basic Services (e.g., forum access, open-source tools) are provided at no cost.

7.2 Premium Services

  • Subscription plans (“Filamexus Pro”) grant access to advanced AI tools, priority support, and ad-free browsing.
  • Fees are non-refundable unless required by law.

7.3 Crowdfunding

  • Campaigns hosted on Filamexus are subject to a 5% platform fee.
  • Creators are solely responsible for fulfilling rewards and complying with tax laws.

8. DISCLAIMERS

8.1 No Warranties

The Services are provided “as-is” and “as-available.” Filamexus disclaims all warranties, including:

  • Merchantability, fitness for purpose, or non-infringement.
  • Accuracy, reliability, or completeness of AI outputs or User Content.

8.2 Third-Party Services

Filamexus is not responsible for:

  • Third-party websites, APIs, or tools linked to the Services.
  • Content, privacy practices, or terms of external platforms.

9. LIMITATION OF LIABILITY

Filamexus, its affiliates, and employees shall not be liable for:

  • Direct, indirect, incidental, or consequential damages (e.g., data loss, business interruption).
  • User misconduct, Prohibited Items, or reliance on AI-generated content.
  • Total liability is capped at £100 GBP or fees paid in the last 12 months, whichever is greater.

10. TERMINATION

10.1 By Filamexus

We may suspend or terminate your account without notice for:

  • Violations of these Terms.
  • Fraudulent, abusive, or harmful behaviour.

10.2 By User

You may delete your account at any time via settings. Note: Public User Content may remain archived.

11. DISPUTE RESOLUTION

11.1 Arbitration

Disputes shall be resolved through binding arbitration in Norwich, UK, under the UK Arbitration Act 1996.

11.2 Class Action Waiver

Claims must be brought individually, not as part of a class or representative action.

11.3 Governing Law

These Terms are governed by the laws of England and Wales, excluding conflict-of-law principles.

12. CHANGES TO TERMS

Filamexus may modify these Terms at any time. Continued use after updates constitutes acceptance.

13. GENERAL PROVISIONS

13.1 Force Majeure

Filamexus is not liable for delays or failures due to events beyond its control (e.g., pandemics, cyberattacks).

13.2 Severability

If any clause is deemed unenforceable, the remainder of the Terms remains valid.

13.3 Entire Agreement

These Terms supersede all prior agreements and constitute the full understanding between you and Filamexus.

14. ANTI-TERRORISM GUIDELINES & SANCTIONS COMPLIANCE

14.1 Prohibition of Terrorist Activities

Filamexus strictly prohibits the use of its Services in any way that supports, facilitates, or funds terrorism or terrorist organizations. This includes, but is not limited to:

  • Designing, manufacturing, or distributing tools, components, or systems intended for use in terrorist acts.
  • Sharing technical knowledge or resources with individuals/entities on sanctioned or watch lists (e.g., OFAC, UN Security Council, EU Consolidated List).
  • Transacting with jurisdictions subject to comprehensive embargoes (e.g., North Korea, Syria, Crimea).

14.2 Sanctions Compliance

  • Filamexus complies with all applicable global sanctions and trade restrictions. Users are responsible for ensuring their activities align with:
    • U.S. Office of Foreign Assets Control (OFAC) regulations.
    • EU restrictive measures.
    • UK Sanctions List.
    • Other national/international sanctions regimes.
  • Accounts linked to sanctioned individuals, entities, or regions will be immediately terminated.

14.3 Reporting Obligations

  • Users must report suspicious activity (e.g., requests for weaponized designs, ties to sanctioned entities) to us.
  • Filamexus will cooperate with law enforcement and regulatory authorities to investigate potential violations.

14.4 Consequences of Violations

  • Immediate account termination and permanent ban.
  • Legal action, including reporting to national authorities (e.g., UK National Crime Agency, INTERPOL).
  • Forfeiture of funds associated with prohibited transactions.

14.5 Prohibited Regions & Entities

Filamexus strictly adheres to global sanctions and trade laws. Access to or use of the Services is prohibited for users in the following regions or affiliated with the listed entities:

14.5.1 Prohibited Regions

  • Countries under comprehensive UN/EU/US/UK sanctions:
    • Crimea (Ukraine region occupied by Russia)
    • Cuba (specific restricted entities only)
    • Iran
    • North Korea (DPRK)
    • Syria
    • Sudan (specific sanctioned entities)
    • Russia (for activities related to military/defence sectors)
    • Belarus (for entities supporting Russia’s war in Ukraine)
    • Venezuela (government sectors only)
    • Myanmar (Burma) (military-linked entities)
    • Zimbabwe (specific individuals/entities)
  • Other restricted jurisdictions:
    • Donetsk & Luhansk (Ukraine regions under Russian occupation)
    • Afghanistan (entities linked to the Taliban)
    • Central African Republic, Libya, Somalia, Yemen (arms embargoes).

14.5.2 Prohibited Entities

The Services may not be used by:

  • Individuals, organizations, or businesses listed on sanctions lists, including:
    • U.S. Office of Foreign Assets Control (OFAC) Specially Designated Nationals (SDN) List.
    • EU Consolidated List of Persons, Groups, and Entities Subject to Sanctions.
    • UK Sanctions List.
  • Entities affiliated with terrorist organizations, arms traffickers, or transnational criminal networks.
  • Organizations involved in weapons of mass destruction (WMD) proliferation.

14.5.3 Enforcement

  • Filamexus conducts automated and manual screenings to block access from prohibited regions or entities.
  • Users are prohibited from circumventing geographic restrictions via VPNs, proxies, or other technical means.
  • Violations will result in:
    • Immediate account termination and permanent bans.
    • Forfeiture of funds linked to prohibited activities.
    • Reporting to relevant authorities (e.g., UK National Crime Agency, OFAC).

15. LEGAL COMPLIANCE

Filamexus operates in accordance with the following laws, regulations, and international frameworks:

17. FINAL PROVISIONS

  • Entire Agreement: These Terms constitute the entire agreement between you and Filamexus, superseding prior agreements or understandings.
  • Severability: If any provision is deemed unenforceable, the remaining Terms remain valid.
  • Waiver: Failure to enforce a provision does not waive Filamexus’s right to enforce it later.
